笔者认为,网络隐私权在性质上兼具人格权和财产权双重属性,应突破传统隐私权理论认为隐私权是一种消极权利的见解,赋予其积极的品格。关于我国网络隐私权保护体系的建构,笔者提出了两点建议:第一,要树立正确的隐私保护观念;第二,构建以法律规制为主,行业自律为辅的网络隐私权保护体系。要在基本法上明确隐私权的地位,同时制定相关的特别法,制定个人数据信息保护法十分必要。 |
